Is the existing access layout acceptable? Does it meet <br />the intent of the Code in providing primary access to the <br />apartment from within the principal structure? <br />2. Should a hardcover variance be granted to allow a 75- <br />250* increase from 28.1% to 32.8%, or should excess <br />hardcover be removed to result in an overall reduction? <br />3. Does Planning Commission have any concerns with the <br />granting of an average setback variance? Will this addition <br />have any significant impact on neighboring properties? <br />If the above issues can be resolved, staff would recommend <br />approval subject to the following additional standard guest <br />apartment conditions: <br />1. The second dwelling unit is allowed as a guest apartment <br />only, to be used for relatives and non-paying guests of the <br />oroperty owners. The unit may not be rented out. <br />2. The two family dwelling or guest apartment use shall <br />cease at such time the current applicants/owners no longer <br />own the property. Any subsequent property owner would hav'' <br />to reapply for this type of use or remove the kitchen <br />facilities. <br />3. Utilities shall not be separated but shall be metered <br />jointly with the principal residence. <br />4. The guest apartment shall not have a separate street <br />address.
