Petition signed by a majority of the neighboring <br />property owners for vacation of the alley. <br />2. Verification that the Hazel Anderson property has a <br />legal easement across the Burger property (and the Gardiner <br />property) to Bayside Road. <br />3. Confirmation of no objection from the utilities which <br />may currently or potentially use this alley. <br />Regarding the setback variances. Planning Commission should <br />consider whether expansion of this house entirely within the 30 <br />rear yard setback is appropriate, or whether applicant should <br />consider expansions southward away from the north lot line. <br />Finally, staff would recommend that the proposed expansion <br />to create a third bedroom (or the potential space for a thirc <br />bedroom), not be approved until such time that municipal sewer is <br />available to the property. Alternatively, applicant should <br />provide septic testing and design work to show that this <br />can support and develop a septic system meeting all code <br />requirements for a 3 bedroom house, plus an alternate site for <br />equivalent septic expansion.
