TO 10:32 P.M. <br />The Affidavit of Publication and Certificate of Mailing were <br />duly noted. <br />There were no comments from the public regarding this matter <br />and the public hearing was closed. <br />It was moved by Planning Commissioner Johnson, seconded by <br />Planning Commissioner Hanson, to recommend approval of the <br />conditional use permit and a 7’ setback variance. TO 9:13 P.M. <br />The Affidavit of Publication and Certificate of Mailing were <br />duly noted. <br />Mr. Ruce was present for this public hearing. <br />Mabusth reviewed the issues involved with this application. <br />Mabusth suggested that it may be appropriate for Mr. Ruce to <br />apply for a Home Occupation License. <br />Kelley asked Mr. Ruce if the commercial use of this property <br />has Intensified since the conditional use permit for the <br />greenhouse was first issued. <br />Mr. Ruce explained, "The garden has two purposes. The <br />terraced area is used for growing plants to sell off~site in my <br />garden business. I'm not a landscaper, I'm a garden designer and <br />in order for me to make the business profitable, I grow the <br />plants I can on the site rather than acquiring them from another <br />source. The second reason for the garden is that I am interested <br />in growing plants that I can cross-pollinate to create different <br />varieties. I tried to make the garden aesthetically pleasing. <br />The only mistake I made is that I did not go through the proper <br />channels to do that. I'm sorry that happened. It was due to my <br />own ignorance more than anything." <br />- 11 -
