Mabusth, Building & Zoning Administrator <br />Date: <br />Subject: <br />March 14, 1990 <br />#1495 Rodney Johnson, 3740 West Wayzata Boulevard <br />Continutation of Public Hearing <br />Addition Exhibits <br />Exhibit H - Planning Commission Action Notice <br />Exhibit I - Letter From Hennepin County Department Of <br />Transporation <br />Exhibit J - Letter From State of Minnesota Department Of <br />Transporation <br />Exhibit K - Surveyor’s Letter <br />Exhibit L “ Amended Plan <br />Review of Amended Proposal - <br />The applicant's surveyor has submitted an amended plan <br />redesignating the current right-of-way of Highway 12 at a total <br />of 83' and Burlington Northern Railroad right-of-way at 150'. <br />His letter also notes the existence of an access permit "#1969" <br />issued to Cliff Otten in September of 1979 for an access road to <br />the nursery area. The access location and drive have been shown <br />on the revised survey. <br />Please review Exhibit I, the report from Hennepin County <br />Department of Transporation. The County asks for an additional <br />17' of right-of-way for a total of 50' from the center line of <br />County Road 6. To be consistent with previous City action, Orono <br />will ask for only 7 additional feet, maintaining a total right- <br />of-way of 80' for the County Road. <br />The report from the State Department of Transporation, <br />Exhibit J, seeks no additional right-of-way for Highway 12 noting <br />that the decision as to the actual location for the Highway 12 <br />Corridor will not be resolved for approximately 2 to 3 years. <br />The State asks that any new access to this property be achieved <br />via County Road 6 approving the existing access serving the <br />resident. As this is not a new development v.ith no changes <br />proposed with this subdivision, the plat is not subject to <br />review by the Minnehaha Creek Watershed District. <br />Staff Recommendation - <br />Staff recommends approval of the proposed 2 lot plat <br />application of Rodney L. Johnson finding thav the subdivision <br />application •»atisfies all standards of the RR-IB Rural <br />Residential Zoning Distict, subdivision regulations for a Class <br />III subdivision and on site septic codes of the City. Each lot <br />has been found to have adequate frontar? on both state and county <br />road. Approval is subject to the followinq conditions?
