Zoning File #1504 <br />March 15, 1990 <br />Page 2 of 3 <br />To achieve access to this site, please use the Folin <br />driveway to the west/right of property. Members may feel more <br />comfortable parking out on Kelly Avenue and walking up through <br />the Folin driveway to the site. The two neighbors on either side <br />of the subject property encourage Mr. Calvert to use the existing <br />easement over Folin's property so as not to impact the existing <br />retaining wall and vegetation adjacent to the roadway. Mr. <br />Calvert concurs, the access drive as shown on the survey matches <br />that easement area. It is hoped that with the development of <br />this site, that the applicant will work closely with the Follns <br />to minimize impact on existing improvement. As the factual <br />findings note above, there is a slight encroachment of the <br />average lakeshore setback line by a second story staircase. <br />Please note Exhibit E, Mr. Folin's letter that claims no <br />objection to the deck stairs. <br />The applicant seeks hardcover variances within the 75-250' <br />setback area noting the following hardships: <br />1. The unusual pie-shape of the lot. <br />2. Of the total 52,500 s.f., 20,900 s.f. is located within <br />the 0-75' setback area. <br />3. The average setback line places the building site in the <br />more restrictive portions of the building envelope. <br />4. The applicant has attempted to minimize hardcover witnin <br />the 250-500' setback area by achieving access via an <br />easement from northwest. <br />5. Note portions of neighbor's driveway are located within <br />applicant's 250-500' setback area (200 s.f. of existing <br />paving). The proposal does not require hardcover variance <br />within 250-500' setback area. <br />Applicant should advise if a staircase is proposed to <br />achieve access to a lakeshore dock. A building permit would be <br />required and such staircase would have to meet the 4' width and <br />4x4' safety stop landings as acceptable standards for the City. <br />The property has been assessed for sewer and water and all <br />assessments have been paid. Water is on the west side of Kelly <br />Avenue. Mr. Calvert has been working with the Public Works <br />Department to determine the best means available to hook-up to <br />the municipal systems. Separate utility connection permits are <br />required.
