Once again for your information, at the time <br />of the North Arm Estates 4th Addition subdivision (the property <br />to the immediate south) the City asked for 17' of right-of-way, <br />there is nothing in the records that would reveal staff <br />researched the history of the previous Co*’ ity road. <br />As meiiibers will remember, during the sketch plan review, the <br />lot line rearrangement is proposed to solve the septic <br />limitations of Lot 1, the most northern lot. In previous <br />discussions with an on-site septic evaluator, it would appear <br />that the lot can sustain only a 2 bedroom residence. The septic <br />limitations result from the filling that took place to the lower <br />eastern portions of the property preventing future septic use. <br />Septic systems cannot be installed within disturbed or filled <br />areas. The sloping properties to the west prevent the <br />installation of mounds. The only suitable area for mound septic <br />systems are located within the southern lot on Lot 2. <br />city reguires 17' of additional right-of-way. Lot 1 will be <br />limited to a 2 bedroom residence. <br />In discussing the proposed subdivision with adjacent <br />neighbors, it would appear that all ask that the City refrain <br />from taking 17' from the east side of the roadway. <br />Staff has enclosed a section of the conceptual <br />transportation study recently completed by Gaffron for the City <br />Council. North Arm Lane has been delineated as a future <br />collector road providing access to Bayside Road, North Shore <br />Drive and North Arm Drive. <br />Gaffron has reconfirmed that any taking of additional right- <br />of-way for North Arm Lane will negate any chance to develop <br />septic systems to the west side of the property. <br />Options of Action - <br />Denial. Finding the proposal to be in conflict with the <br />directives of the Comprehensive Plan of the City and the Orono <br />Zoning Code; or <br />Approval. To approve the proposed lot line rearrangement <br />and lot width variance for Lot 2 of 123.87 or 61.93% and not <br />require the dedication of 17* of additional right-of-way for <br />North Arm Lane based on the following findings: <br />1. The City had previously vacated all interest in 33 o. <br />right-of-way located within the subject property. <br />2. Lot 2's lot width now conforms to the required 200 of <br />width adjacent to the channel area considered the lakeshore <br />of Lake Minnetonka.
