Mabusth, Building & Zoning Administrator <br />Date:August 15, 1990 <br />Subject: Chuck Downey, 2665 Casco Point Road - <br />A) #1493 Variances - Referred back to Planning <br />Commission by Council for Further Review <br />B) #1570 Conditional Use Permit/Variance - <br />Public Hearing <br />Status of Application #1493 - <br />At the March 19, 1990 meeting of the Planning Commission, <br />members approved an entry addition at 6'xl9' to the street side <br />of the existing residence requiring approval of excessive <br />hardcover within the 75-250' setback area. The property was <br />found to have approximately 4,516 s.f. or 54%. The Planning <br />Commission based their approval on the removal of some 787 s.f. <br />of hardcover, reducing hardcover to 45%. This approval was <br />conditioned on applicant removing approximately 9% of hardcover, <br />bringing the total hardcover within the 75-250' setback area to <br />the original approved hardcover level in an earlier 1982 review. <br />At the Council meeting, the applicant advised Council of his <br />concern with the request to remove the additional hardcover in <br />the granting of the approval of the hardcover variance for the <br />entry addition noting the entry addition would result in only 30 <br />s.f. of additional hardcover because existing paved areas already <br />exist under the portions of the proposed entry. The applicant <br />also advised of plans to do alterations within his lakeshore yard <br />to decrease the erosion that was taking place from excessive <br />runoff received from the lot to the immediate south. Council <br />members also questioned the legality of the second story lake- <br />shore deck constructed some time in 1982 without the obvious <br />benefit of the building permit review. Council advised the <br />applicant that they would table all action on this application <br />and advised the applicant to file a conditional use permit <br />application for the proposed land alterations within the lake- <br />shore yard, and asked for an updated survey recording all <br />existing and proposed hardcover on the property. A conditional <br />use permit has been filed by the applicant and an updated survey <br />submitted for the current review and the second review of <br />application #1493.
