1 • <br />I <br />t <br />9 <br />\ <br />-T.r.-- . <br />City of ORO]NO <br />\ - -H... <br />V ' *I <br />\ - •cT; <br />RESOLUTION OF THE CITY COUNCIL <br />NO. ________________ <br />A RESOLUTION GRANTING <br />A CONDITIONAL USB PERMIT TO <br />MUNICIPAL ZONING CODE <br />SECTION 10.03, SUBDIVISION 19 AMD <br />SECTION 10.55, SUBDIVISION 9 (B) (3) AND <br />VARIANCES TO <br />MUNICIPAL ZONING CODE <br />SECTION 10.22, SUBDIVISION 2 AND <br />SECTION 10.55, SUBDIVISION 8 <br />* FILE #1131 <br />WHEREAS, Guenther and Gertrud Noelting (hereinafter *the <br />applicants ”) are the owners of the property located at 1060 Tonkawa Road <br />within the City of Orono (hereinafter ”City ”) and legally described as Lot <br />1, Block 1, Ryanwood, Hennepin County, Minnesota (hereinafter "property ”}; <br />and <br />WHEREAS, the applicants have made application to the City of <br />Orono to permit the installation of a permanent dock per Section 10.03, <br />Subdivision 19 and Section 10.55, Subdivision 9 (B)(3) and variances to <br />Section 10.22, Subdivision 2 and Section 10.55, Subdivision 8 to allow the <br />excavation of the lakeshore to permit the construction of the <br />support/foundation structure. <br />Minnesota: <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, <br />FT.NDINGS <br />1. This application was reviewed as Zoning File #1131. <br />2. The property is located in the LR-IB Single Family Lakeshore <br />Residential Zoning District. <br />3. The property is approximately 1.00 acre in area. <br />4. The Orono Planning Commission reviewed this application on April <br />20, 1987, and recommended approval of the proposed variances to permit <br />excavation within the lakeshore protected area where none is allowed <br />per Zoning Code Section 10.22, Subdivision 2 and Section 10.55, <br />Subdivision 8, and recommended approval of a conditional use permit <br />per Section 10.03, Subdivision 19 and Section 10.55, Subdivision 9 <br />(B)(3) to allow the installation of a permanent dock based on the <br />following findings: <br />A) The applicants propose no change in existing elevations or <br />drainage. <br />Page 1 of 4 <br />i
