TO:Mayor and City Council Members <br />Planning Commission Chairmon and Planning Conunission Members <br />FROM:Jeffrey Johnson <br />3825 Cherry Avenue <br />Orono, MN <br />DATE: <br />RE: <br />March 23, 1990 <br />Variance Request <br />I purchased Lot 2, Block 3 Crystal Bay View with the intent of providing <br />lakeshore access for my homestead at 3825 Cherry Avenue. This lot was <br />purchased from Marion Schulz of Philomath, Oregon. <br />My request is to grant a variance to the City Code to allow the construc <br />tion of a permanent dock from my homestead property across platted right- <br />of-way of Cherry Avenue, across the wetland portion of Lot 2 to the <br />shoreline of North Arm. The dock will be approximately 3* wide by 200' <br />long. The portion of Cherry Avenue that the proposed dock would cross is <br />totally within the wetland area and is not used for roadway purposes and <br />is unimproved. <br />By granting this variance request, the City of Orono can be assured the <br />use of Lot 2 will be "tied" to an adjacent homestead parcel and will not, <br />at some future date, be the subject of a land use independent of any <br />homestead. <br />This request does meet the Lake Minnetonka Conservation District's <br />criteria for authorized dock use. <br />I feel that this request meets all of Orono's requirements for a variance, <br />including hardship involved with the land itself, uniqueness, and no <br />adverse affect on adjoining property owners or the public generally.
