Technically a <br />variance must be granted to this section of the code because <br />the lakeshore lot is divided from the homestead portion of <br />the property by an unimproved platted right-of-way. Hence <br />the dock classified as an accessory structure cannot receive <br />credit of principal residence. <br />Section 10.03, Subdivision 9 (A) - The code requires a <br />principal residence on the lot prior to construction of an <br />accessory structure. Once again, the County confirms the <br />ability to legally combine the three parcels. <br />Section 10.22, Subdivisions <br />setback/hardcover. <br />1 and 2 - Lakeshore <br />A) The 200* length dock will encroach the wetlands <br />area located above the 929.4' elevation and is located <br />within 75' of the defined lakeshore at the 929.4' <br />elevation. The DNR is reviewing tne portions of the <br />application that involve structure at or below the <br />929.4' elevation. The DNR also advises that the Corp <br />of Engineers will be reviewing placement of the dock in <br />relation to nagivaticnal issues in the immediate area. <br />The total dock consists of COO square feet of hardcover <br />structure, the majority of which is located below or at <br />the 929.4' elevation. <br />Hardcover within the 250 —500' setback area: <br />Area * 23,183 s.f. <br />Allowed Hardcover ” 6,954.9 s.f. or 30% <br />Existing Hardcover ■ 2,790 s.f. or 12.1% <br />(refer to Exhibit E)
