A <br />condition of the lot line rearrangement also Included the <br />execution of a developer's agreement and supportive security <br />to assure that the improvements required for single family <br />residential use of the property were installed. If a <br />conditional use permit is granted, approval must provide <br />notice to both the Art Center and Mr. Schneider, the current <br />owner, and any future owner that prior to the City issuing a <br />building permit for single family use of the property, the <br />Art Center must re-execute a developer's agreement and <br />submit appropriate security to Insure the required site <br />Improvements originally established in the review of <br />application #1397 are installed. <br />Options of Action - <br />1. Denial. If Planning Commission denies the conditional <br />use permit, please refer to Section 10.09, Subdivision 6 <br />(A). <br />2. Approval. If approved. Planning Commission may wish to <br />consider one or more of the following findings: <br />A) The structure has existed on the property without <br />neqative impact on the surrounding adjacent residential <br />neighborhood. <br />B) No other changes are proposed on the site or within <br />the structure as a result of this new request. <br />C) The use is consistent with the Intent of the Zoning <br />Code and Orono Comprehensive Plan. <br />Approval should be subject to the following conditions: <br />1. The school structure must be connected to municipal <br />sewer by March 15, 1990. <br />2. Prior to the City issuing a building permit for the <br />renovation to single family residential use of the <br />structure, the Art Center of Minnesota must submit a newly <br />executed developer's agreement and post an acceptable <br />security to the City to ensure the required site <br />Improvements established in the review of Application #1397 <br />are installed. At the time of the conversion, if the Art <br />Center no longer holds any interest in the adjacent <br />property, the current o%mer of 2180 North Shore Drive will <br />be responsible for site improvements. Mr. Schneider may be <br />best advised to work out a separate agreement with the Art <br />Center to safe-guard his Interest in this matter. At any <br />rate, it must be made clear to both parties that if single <br />family use is to be installed, that either one or the other <br />will be held responsible for the installation of the <br />Improvements by the City of Orono.
