Gaffron» Asst Planning & Zoning Administrator <br />Date: <br />Subject: <br />December 21, 1989 <br />Consideration of Amendment to Recently Adopted Accessory <br />Structure Ordinance: Inclusion of Pools as Lot Coverage <br />Introduction - <br />On August 14, 1989, the City Council adopted Ordinance 72, <br />Second Series which regulates location, area, and height of large <br />accessory structures (copy attached as Exhibit A). That <br />ordinance amended Zoning Code Section 10.03, Subdivision 14 (C) <br />by limiting the percentage of lot coverage by structures on all <br />lots 1.99 acre or smaller. Prior to adopting that regulation, <br />upon staff recommendation the Council revised and detailed the <br />language such that all roofed structures which extend more than <br />6' above grade, and any tennis courts, pools, patios, decks and <br />other open structures which are fully or partially surrounded by <br />fences that are more than 6' high, would count toward lot <br />coverage. <br />On September 25, 1989, the Council discussed reconsidering <br />whether pools should be included in the lot coverage calculation, <br />regardless of fence height. On October 23, 1989, pursuant to a <br />memo of October 19, 1989 from the City Administrator, Council <br />directed staff to initiate the process for consideration of such <br />an amendment. <br />Based on the City Cour.cll's discussion, the amendment to be <br />considered would be to revise Section 10.03, Subdivision 14 (C) <br />to read as follows: <br />"C. Lot coverage. In all zoning districts, for all lots of <br />0-1.99 acre in total area, the total combined footprint <br />areas of all principal and accessory structures shall not <br />exeed 15% of the lot area. The following shall be included <br />in calculation of lot coverage by structures: <br />1. All roofed structures which extend more than 6' <br />above grade level. <br />2. Tennis courts, pooisr <br />similar "open" structures <br />enclosed by fences, railings <br />than 6' above grade level <br />structures extends more than <br />entire structure shall count <br />patios, decks, and all <br />when partially or fully <br />or walls which extend more <br />(if any portion of such <br />6* above grade level, the <br />toward lot coverage). <br />MauIlL
