Upon inspection staff confirmed that the property owner had installed an <br />approximate 1,175 square foot paver parking area within the 75-foot setback connected to the <br />existing driveway (highlighted in pink). When notified of the violation, rather than removing the <br />added parking area, the applicant has requested an after-the-fact hardcover setback variance. <br /> <br />At the end of October, the <br />applicant submitted the <br />requested as-built survey <br />showing the newly installed <br />driveway improvement for the <br />after-the-fact variance <br />application. Upon review for the <br />after-the-fact driveway <br />variance, staff noted two <br />additional unpermitted patio <br />improvements on the property: <br />a newly constructed 500 square <br />foot fire pit patio area on the <br />north portion of the property, <br />43 feet from the OHWL <br />(highlighted in orange); and a <br />second 470 square foot fire pit <br />patio area 50 feet from the <br />OHWL on the east side of the <br />home (highlighted in green). <br /> <br />Throughout the summer of <br />2022, staff worked with the <br />property owner on several <br />compliance issues prior to <br />completion of the home’s <br />Application Summary: The applicant is requesting after-the-fact approval of variances for <br />hardcover within the 75-foot setback. <br />Staff Recommendation: Planning Department Staff recommends denial.
