MINUTES OF THE <br />ORONO PLANNING COMMISSION <br />October 17, 2022 <br />6:00 o’clock p.m. <br />_____________________________________________________________________________________ <br /> <br />Page 1 of 6 <br /> <br />ROLL CALL <br /> <br />The Orono Planning Commission met on the above-mentioned date with the following members present: <br />Chair Mark McCutcheon, Commissioners Chris Bollis, Dennis Libby, Scott Kirchner (arrived at 6:01 <br />p.m.), Jon Ressler, Bob Erickson. Commissioner Matt Gettman. was absent. Representing Staff were <br />Community Development Director Laura Oakden, City Planner Melanie Curtis, and City Planner Natalie <br />Nye. <br /> <br />Chair McCutcheon called the meeting to order at 6:00 p.m., followed by the Pledge of Allegiance. <br /> <br />APPROVAL OF AGENDA <br /> <br />Libby moved, Ressler seconded, to approve the Agenda. VOTE: Ayes 5, Nays 0. <br /> <br />APPROVAL OF PLANNING COMMISSION MEETING MINUTES OF SEPTEMBER 19, 2022 <br /> <br />Bollis moved, Erickson seconded, to approve the minutes of the Orono Planning Commission <br />meeting of September 19, 2022. VOTE: Ayes 5, Nays 0. <br /> <br />PUBLIC HEARINGS <br /> <br />1. LA22-000041 ESKUCHE DESIGN, 3005 CASCO POINT ROAD, REQUESTS <br />VACATION OF PERIMETER DRAINAGE AND UTILITY EASEMENTS IN <br />CONJUNCTION WITH AN ADMINISTRATIVE BOUNDARY LINE ADJUSTMENT. <br />(STAFF: MELANIE CURTIS) <br /> <br />A representative from Eskuche Design, Applicant, was present. <br /> <br />Curtis gave a presentation on the item, stating the Applicant is seeking approval of vacation of existing <br />perimeter drainage and utility easement in the plat of Hartzell Addition which are no longer necessary and <br />create a conflict due to an administrative lot combination creating two lots where three currently exist. <br />Easements will be granted along the new boundaries between the two combined lots. The Applicant <br />received an average lakeshore setback variance for 3005 Casco Point Road under this same application <br />number in September (Resolution No. 7284). Although many of the neighbors have expressed concerns <br />about development of the subject properties and stormwater management, to date no public comments <br />have been received specifically on the vacation of the easements. Staff recommends approval of the <br />easement vacation requested in conjunction with the owner’s granting replacement easements. <br /> <br />Chair McCutcheon opened the public hearing at 6:04 p.m. <br /> <br />Bonnie Martinson, 2970 Casco Point Road, asked if drainage and water is also part of a utility. <br /> <br />Chair McCutcheon noted when one changes lot lines they want to have an easement so they can do a <br />swale where the water can go. <br /> <br />Ms. Martinson asked if that will come before the Planning Commission. <br />
