QUESTIONS OF THE APPLICATION: <br /> <br />The information provided by the applicant will be used in determining whether to approve or <br />deny the request. <br /> <br />1) The variance is in harmony with the general purpose and intent of Chapter Two, City <br />Code of Ordinances : <br />The variance is in harmony with the general purpose and intent. We are renovating an existing legally <br />nonconforming structure and seeking to improve and/or maintain the current legal nonconformity of the <br />structure. The intent and use of the property remains the same as a single-family structure. <br /> <br />2) The variance is consistent with the Comprehensive Plan and will not alter the essential <br />character of the locality? <br />Yes, the variance is consistent with the current Comprehensive plan. <br /> <br />3) State the practical difficulties in complying with the standards contained in Chapter Two, <br />including but not limited to inadequate access to direct sunlight for solar energy systems. <br />The property was originally built to meet the zoning requirements at the time of construction. As <br />changes in the city have been made, the structure no longer meets the current zoning requirements. We <br />are seeking to comply with the standards and maintain reasonable use of the property. We are doing this <br />by reducing massing and legal nonconformity in some parts of the structure while maintaining legal <br />nonconformity in the remaining parts of the structure. <br /> <br />4) State how the applicant proposes to use the property in a reasonable manner not permitted <br />by the standards contained in Chapter Two: <br />The property is to be used as a single-family home as it was intended. <br /> <br />5) The plight of the applicant is due to circumstances unique to the property and not created <br />by the landowner <br />The structure was built when the zoning code allowed it to be built as it is today. The property owners <br />did not change the zoning requirements, therefore making it legally nonconforming today. <br /> <br />6) Address how economic considerations alone do not constitute practical difficulties <br />The current structure and care of the home had been deferred for years prior to the property owners <br />purchasing it. Improvements are being made to improve the current structure and correct the design <br />flaws that it has for the function of the home and how it works today. <br /> <br /> <br />
