,BOAT CITY OF ORONO <br /> RESOLUTION OF THE CITY COUNCIL <br /> y� NO. 7306 <br /> "itESHOv-t <br /> Based upon one or more of the above findings, the Orono City Council hereby <br /> amends the approved plans associated with a variance to Orono Municipal Zoning Code Section <br /> 78-305 to allow construction of an 18' x 12' deck and stair to be located within the 50-foot rear, <br /> street yard setback; and Section 78-1279 to allow construction of a deck within the 75' lake yard <br /> setback; and Section 78-1680 to allow hardcover within the 75-foot setback area for the new deck <br /> for a total site hardcover level of 3,905 square feet or 24.04%, subject to the following conditions: <br /> 1. Council approval is based on the entire record, including Findings outlined in Resolution <br /> No. 7179. <br /> 2. The approved project shall conform to the site plan and building plans submitted by the <br /> Applicants attached to Resolution No. 7179, and the revised deck plan attached to this <br /> Resolution as Exhibit A. <br /> 3. Any amendments to the plans which are not in conformity with City codes may require <br /> further Planning Commission and City Council review. <br /> 4. Authorities granted by this resolution run with the Property not with the Applicants, but are <br /> permissive only and must be exercised by obtaining a building permit for the new <br /> construction and commencing construction of said project. The original approval with <br /> Resolution 7179 was administratively extended and set to expire on June 28, 2023. A <br /> building permit must be obtained by June 28, 2023 or the variances will expire. <br /> 5.
