The condition of the permit was <br />that the dredging be done in accordance with the Mirnehaha <br />Creek Voater Shed District, the Lake Minnetonka Corservation <br />District, and the Departzent of rraturai Resources Permit, <br />They also provided that there should be no placement of <br />any dredge material in any of the wttl.ands. <br />Bill bli l l s advised the property owner, Robert Di.rkeland, <br />of these and other conditions in a lettr�r of June A, 1973. <br />He instructed him to contact his office when the dredging <br />was begun. <br />lie received notice on February 26, 1974 that the project <br />was in progress. On the following morning we inspected <br />the progress and found that the dredging was nearly complei:ede <br />We also found that contrary to all instructions the fill <br />had been placed in what appeared to be wetlands. This was <br />.i.tirlicated by the markings on the USGS naps as well as <br />cattails and other marsh type grasses in the area c)f his <br />fill deposits. Mr. Birkeland advised us that he had <br />cleared this with Bill Mills and had deposited the fill <br />w:"re they had agreed. <br />v � a contacted Bill and made the inspection of the site <br />with him and he conf irmed our observations that this was <br />i n fact wetlands.
