G4` No. 7298 <br /> <Is`-kEsHO0' <br /> A RESOLUTION <br /> APPROVING A VARIANCE FROM <br /> MUNICIPAL ZONING CODE <br /> SECTION 78-420 <br /> FILE NO. LA22-000043 <br /> WHEREAS, on August 15, 2022, John deGarmo and Sanja deGarmo, a married <br /> couple, (hereinafter the"Applicants"), applied for a variance from the City Code for the property <br /> addressed 2675 Fox Street and legally described as: <br /> That part of the Southeast Quarter described as follows: Beginning at a point in the <br /> West line of said Southeast Quarter distant 796.125 feet(48%rods) North of the Southeast <br /> corner of said Southeast Quarter; thence East 940.5 feet(57 rods); thence North 397.87 <br /> feet(23% rods); thence West 940.5 feet(57 rods); thence South 391.875 feet(233/4 rods)to <br /> the point of beginning, EXCEPT the West 389.00 feet thereof, Section 4, Township 117 <br /> North, Range 23 West of the 5'h Principal Meridian, Hennepin County, Minnesota <br /> (hereinafter the "Property"); <br /> WHEREAS, the Applicants have made application to the City of Orono for a <br /> variance to Orono Municipal Zoning Code Section 78-420 to allow construction of an attached <br /> garage addition 35 feet from the front property line where a 50 foot setback is required; and <br /> WHEREAS, on September 19, 2022, after published and mailed notice in <br /> accordance with Minnesota Statutes and the City Code, the Planning Commission held a public <br /> hearing, at which time all persons desiring to be heard concerning this application were given <br /> the opportunity to speak thereon; and <br /> WHEREAS, on September 19, 2022, the Planning Commission recommended <br /> approval of the variance; and <br /> WHEREAS, on October 10, 2022, the City Council reviewed the application and <br /> the recommendations of the Planning Commission and City staff; and <br /> NOW, THEREFORE, BE IT RESOLVED that the City Council of Orono, <br /> Minnesota hereby approves the requested variance as described above based on one or more <br /> of the following findings of fact concerning the Property: <br /> FINDINGS OF FACT: <br /> 1. This application was reviewed as Zoning File#LA22-000043. The analysis contained <br /> within staff memos and the exhibits attached to the aforesaid memos, all minutes from <br />
