BOA/ CITY OF ORONO <br /> RESOLUTION OF THE CITY COUNCIL <br /> s� �: NO. 7284 <br /> ��1 ESHO�� <br /> A RESOLUTION <br /> APPROVING A VARIANCE FROM <br /> MUNICIPAL ZONING CODE <br /> SECTION 78-1279 <br /> FILE NO. LA22-000041 <br /> WHEREAS, on July 20, 2022, Peter Eskuche with Eskuche Design (hereinafter the <br /> "Applicant")who represents Watertower LLC (hereinafter the"Owner"), applied for a variance on <br /> the property owners' behalf from the City Code for the property addressed 3005 Casco Point <br /> Road and legally described as: <br /> Lot 3 and that part of Lot 2, Block 1, HARTZELL ADDITION which lies southerly of <br /> the following described line and it's extensions: Commencing at the most easterly <br /> corner of said Lot 2; thence northwesterly 34.03 feet along the northeasterly line of <br /> said Lot 2 being a curve having a radius of 725.00 feet; thence North 46 degrees <br /> 43 minutes West tangent to last described curve and along said northeasterly line <br /> of Lot 2 a distance of 2.50 feet to the point of beginning of said line; thence South <br /> 64 degrees 04 minutes 01 seconds West to the shore of Lake Minnetonka and <br /> said line there ending, Hennepin County, Minnesota (hereinafter the"Property"); <br /> WHEREAS, the Applicant has made application to the City of Orono for a <br /> variance to Orono Municipal Zoning Code Section 78-1279 to allow construction of a new home <br /> 173 feet from the OHWL where the applied average lakeshore setback is 210 feet; and <br /> WHEREAS, on August 18, 2022, after published and mailed notice in accordance <br /> with Minnesota Statutes and the City Code, the Planning Commission held a public hearing, at <br /> which time all persons desiring to be heard concerning this application were given the <br /> opportunity to speak thereon; and <br /> WHEREAS, on August 18, 2022, the Planning Commission recommended denial <br /> of the variance; and <br /> WHEREAS, on September 12, 2022, after reviewing the application and the <br /> recommendations of the Planning Commission and City staff, Council identified practical <br /> difficulties which support granting of the requested variance and directed preparation of findings <br /> for approval of the variance. <br /> NOW, THEREFORE, BE IT RESOLVED that the City Council of Orono, <br /> Minnesota hereby approves the requested variance as described above based on one or more <br /> of the following findings of fact concerning the Property: <br />
