structure is 8’ from the property line where 10’ is required and our proposal is 28’ (well in excess of the <br />requirement) in consideration of the neighbor’s concerns. <br /> <br />The uniqueness of our request should also be a consideration in the council’s decision. The <br />development of this property combines 3 lots into 2 that are controlled by related parties building <br />homes simultaneously. The existing structures can be remodeled which would leave existing non- <br />conformities unimproved. Building the home on the Northern lot first, with a lesser, but conforming <br />lakeshore setback would allow the home on the Southern lot to push closer to the lake and lessen the <br />need for this current request; however, it would also impede the view of both the home to the North <br />(Goodwin’s) as well as the subject home and break form the character of the overall neighborhood. If <br />approved, our proposal avoids these complications, improves the ALS encroachment, cures the side yard <br />setback encroachment, improves the views of the neighbor to the south and preserves the overall <br />character of the neighborhood. <br /> <br />It is our beliefthe ALS intent is to create uniformity in the lakeshore setback of lots, taking into account <br />irregular lot shapes, preserving views and preserving character of properties around the lake.
