This application is regarding a lakeshore setback variance in order to reconstruct retaining <br />walls and a lake access stair with different materials. <br /> <br />2. MN§15.99 Application Deadline. The application was received on July 20, 2022, and considered <br />to be complete on July 27th. Therefore the 60-Day review period expires on September 25, 2022. <br /> <br />3. Background/ Summary. The subject property has <br />an existing, failing wood wall and stair system. The <br />applicant plans to reconstruct all of the walls and stairs <br />in a similar location and setback from the lake. However, <br />due to the change in wall materials from timber to <br />boulders, the walls will have a larger footprint than <br />existing. The existing stair is narrow (ranging between <br />18” and 2.5 feet in width) and not very functional. <br />They’ve provided an opinion from an engineer regarding <br />the condition of the existing walls which indicates they <br />are in a failing condition (Exhibit D). <br /> <br />The proposed plans reflect installation of a 4 foot wide <br />granite stair with a 12 square foot pea rock landing at the <br />turn. Additionally, in order to provide for a better <br />opportunity for screening, they have broken up the upper <br />wall into two lower tiers which will not require an <br />engineered plan. A setback variance is required for the <br />new walls. <br /> <br />4. Planning Commission Vote and Comment. On <br />August 15th, the Planning Commission held a public <br />hearing and discussed the revised wall plan <br />configuration. Following the public hearing the Planning <br />Commission voted 5 to 0 on a motion to approve the <br />requested lakeshore setback variance for the new walls. <br /> <br />5. Public Comment. No comments from the <br />neighbors were received. <br /> <br />6. Staff Recommendation.
