This application is regarding an average lakeshore setback variance in order to rebuild a <br />deck in a different configuration. <br /> <br />2. MN§15.99 Application Deadline. The application was received on July 15, 2022, and considered <br />to be complete on July 19th. Therefore the 60-Day review period expires on September 17, 2022. <br /> <br />3. Background/ Summary. The applicants <br />have an existing elevated deck on the south <br />side of their home facing the lake (shown in <br />yellow) situated entirely lakeward of the <br />average lakeshore setback line (green). The <br />deck is a screened in, half circle, with a patio <br />below and a pergola above. They wish to <br />construct a new, more functional, rectangular <br />deck (shown in red). The new deck will be <br />approximately 100 square feet larger than the <br />existing. However, the new deck will be two <br />feet further from the lake than existing. <br />Additionally, the existing deck encroaches <br />into the required street setback from <br />Fagerness Point Road; the new deck will <br />resolve this encroachment. <br /> <br />4. Planning Commission Vote and <br />Comment. On August 15th, the Planning <br />Commission held a public hearing. Following <br />the public hearing the Planning Commission <br />voted 5 to 0 on a motion to approve the <br />requested average lakeshore setback variance <br />for the new deck. <br /> <br />5. Public Comment. Comments from the neighbors were received and are attached as Exhibit D. <br /> <br />6. Staff Recommendation.
