Tlie conditions that apply to lliis <br /> property are simila�• to conditions tliat apply to otlzer Big Island properties, <br /> with the exception that the property is guided and used as a public park. <br /> Without the variances a suitable dockage situatio�7 fo�•public use of this public <br /> property would not be feasible, and reaso�zable use would be denied. <br /> Granting of the variances will have no negative impacts and will be i�1 keepi�zg <br /> with the public use intent of the City for this property. If the variances are not <br /> granted, the City will not be able to provide a safe,fu�ictional dockage situation <br /> for this public property. Since access via boat is tl:e only mea�zs of access to <br /> the property, tlze inabiliry to provide a safe, functioiial access would be a <br /> hardship. <br /> 9. The City Council has considered this applicatioiz including the findings and <br /> recommendations of the Planning Commission, reports by City staff, comments by <br /> the applicants and the public, and the effect of the proposed variances on the health, <br /> safety and welfare of the community. <br /> 10. The City Council finds that the conditions existing on this property are peculiar to it <br /> and do not apply generally to other property in this zoning district; that granting the <br /> variances and conditional use permit would not adversely affect traffic conditions, <br /> light, air nor pose a fire hazard or other danger to neighboring property; would not <br /> merely serve as a convenience to the applicant and owner, but are necessary to <br /> alleviate a demonstrable hardship or difficulty;are necessary to preserve a substantial <br /> property right of the applicant; and would be in keeping with the spirit and intent of <br /> the Zoning Code and Comprehensive Plan of the City. <br /> CONCLUSIONS, ORDER AND CONDITIONS <br /> Based upon one or more of the above findings, the Orono City Council hereby grants variances to <br /> Orono Municipal Zoning Code Section 78-1282 to allow up to four concrete dock landing pads to be <br /> constructed in excess of the 32 s.f. maximum area normally allowed within the 0-75' zone for <br /> Page4of7 <br />
