The purpose of this action item is to gain Council approval to commence the planning and <br />engineering of the Spruce Place right-of-way realignment project. <br /> <br />2. Background. The majority of the paved roadway of Spruce Place is not located within the platted <br />public right-of-way. Additionally, because of the road alignment, several of the homes on the lake side of <br />Spruce Place have improvements/buildings constructed up to and/or within the right -of-way corridor. The <br />roadway is narrow, and Spruce Place does not terminate in a cul-de-sac. The dead-end configuration <br />results in challenges for residents, delivery drivers, and garbage haulers. A shift in property lines would <br />correct the roadway to be within public right-of-way and to provide some relief to the abutting properties <br />with current right-of-way encroachments. <br /> <br />At the April 11, 2022 Council Work Session, staff provided information to the Council regarding this <br />possible solution. Ray and Linda Hoffmann are the owners of 1254 Loma Linda (shown on the aerial <br />image Exhibit B). They also own the vacant unaddressed lot between their property and 1295 Spruce <br />Place (owned by the City). The Hoffmann’s have indicated an interest in working with the City toward a <br />solution which would involve trading City right-of-way for a portion of their property in addition to an <br />encroachment agreement to address their existing driveway improvements. Council directed staff to <br />proceed and request an estimate from Bolton & Menk for the surveying and engineering work. <br /> <br />3. Neighborhood Notification. In May of 2022, letters were sent to owners of nine properties along the <br />Spruce Place corridor to inform them of the City’s exploratory project. A sample of the letter is attached <br />as Exhibit C. Two additional properties were added to the scope since the April work session. Four <br />property owners have reached out to staff with questions; their response to the potential project has been <br />generally positive. <br /> <br />4. Scope. The scope of Bolton & Menk’s services would include surveying, property research and <br />right-of-way computations, set new monuments, and preparation of vacation and encroachment exhibits. <br />The administrative paperwork, public hearings, and neighbor communications will be handled by staff. <br /> <br />5. Engineering and Design Cost. Bolton & Menk has provided a scope of services for a fee estimate <br />not to exceed $16,000 (Exhibit A). <br /> <br />6. Funding. The engineering and subsequent legal review and recording costs will be funded by the <br />Engineering Operation Budget. <br /> <br />COUNCIL ACTION REQUESTED: <br />Move to direct staff to move forward with the Spruce Place right-of-way realignment project and <br />acceptance of the Bolton & Menk’s proposal. <br /> <br />Exhibits <br />A.
