The applicant has requested that the City confirm, by Resolution, that the three conditions <br />identified in Resolution 7211 vacating a portion of Westlake Street have been met. <br /> <br />2. Background. In August, the City Council approved the vacation of a portion of Westlake Street, via <br />Resolution 7211. This resolution had the following three requirements before the vacation could be <br />recorded. <br /> <br />1. The applicant agrees to grant the public a drainage and utility easement to protect existing <br />drainage and utility infrastructure. <br /> <br />2. The applicant agrees to provide right of way for the completion of the cul-de-sac at the proposed <br />southern terminus of Westlake Street. <br /> <br />3. The applicant agrees to his unsolicited a donation of $100,000 to facilitate public improvements <br />and services in the area. <br /> <br />The Resolution 7211 is attached as Exhibit B. The two required documents have been signed and the <br />applicant has made a donation to the City meeting all the requirements for the vacation approval. <br /> <br />3. Staff Recommendation. Staff recommends approval of Resolution 7277 confirming all the required <br />conditions of Resolution 7211 have been met. <br /> <br />COUNCIL ACTION REQUESTED <br />Motion to adopt Resolution 7277, confirming all the required conditions of Resolution 7211 have been <br />met. <br /> <br />Exhibits <br />A.
