The applicants are requesting lot width variances for both lots with the goal of a boundary <br />line adjustment. <br />2.Background. Ressler and Plachecki are neighboring property owners at 3683 and 3685 North Shore <br />Drive. The applicants are looking to complete an administrative boundary line adjustment (officially <br />called a Subdivision Exception) which can be completed by staff and recorded by the owner. Moving the <br />property boundary is a staff administrative action as long as no new non-conformities are created or an <br />existing non-conformity is not increased. The requested variance, if granted, would allow the City to <br />administratively adjust the boundary line. <br />Each property will require a lot width variance in order to allow the boundary line adjustment. Lot width <br />is measured in 2 places on lakeshore properties, at the ordinary high water level (OHWL) and at the 75’ <br />lakeyard setback. Properties in the LR-1C district require 100’ lot width. <br />Similar to other nearby properties, both of these lake-front properties are nonconforming to lot width, area <br />and setbacks. Due to the angle of the proposed lot line, the lot width will decrease at the 75’ lakeyard <br />setback from 54’ to 52’ at 3683 North Shore Drive and at 3685 North Shore Drive it will decrease from <br />92’ to 82’ at the OHWL. The new property boundary will maintain the same lot areas overall. Most <br />relevant to the City Council’s consideration, the proposed new property line will improve many non- <br />conformities on the both parcels. The building setback, overall hardcover and lot width at the OHWL <br />will improve for 3683 North Shore Drive and the new property line will be move off of the existing <br />driveway bringing the driveway setback closer to conformance for 3685 North Shore Drive. These results <br />will, therefore, further the goals of protecting against overcrowding at the lakeshore in this zoning district <br />and lessen difficulties created by historical development in the neighborhood. Furthermore, the decrease <br />in hardcover at 3683 North Shore Drive serves to mitigate the impacts of hardcover runoff and improve <br />storm water management in the area. <br />3.15.99 Deadline. The application was complete on May 5, 2022. The 60 Review Period expires July <br />2, 2022. <br />4.Planning Commission Vote and Comment. On May 16, 2022, the Planning Commission held a <br />public hearing. The commission reviewed the application and discussed support for the application. <br />They noted the improvement to the hardcover calculations and building setbacks were important <br />improvements to the sites. No comments were made during the public hearing. The commission voted 7 <br />to 0 to approve the lot width variances for both properties. <br />5.Public Comment. No comments from the public have been received <br />6.Staff Recommendation.
