To review the variances for building, hardcover, and retaining walls in the 75’ lakeyard <br />setback, side yard setback, as well as a lot area variance for the construction of a new house. As well as, a <br />wetland setback variance for new entrance monuments. <br />2.Background. This property has a unique lakeshore inlet (“French Lake Creek”) from Lake <br />Minnetonka on the west side of the property establishing an additional 75-footlake yard in addition to the <br />75-foot lakeyard from the lake on the south side of the property. The applicant is proposing to build a <br />new home and is working to utilize some of the existing footprint of the current house. The existing <br />home sits about 18 feet from the Lake Minnetonka and 50 feet from the inlet on the west. The applicant <br />proposes to construct the new home further from the lake, 36.5 feet from the OHWL of the lake, and 53 <br />feet from the OHWL of the inlet. The proposal includes the removal of hardcover on the west and south <br />sides of the property. To minimize the inlet encroachment, the applicant proposes to move the home <br />closer to the east side property line, into the east side yard setback. The applicant has designed the home <br />to improve the current setbacks and hardcover encroachments. <br />The application depicts a new location for entrance monuments. The property currently has entrance <br />monuments that can be rebuilt or maintained. If the existing entrance monuments are removed, the new <br />monuments would be required to meet all city code standards. The new entrance monuments in the <br />proposed location create a larger setback from North Shore Drive, however the proposed monuments are <br />approximately 5 feet from the edge of the wetland where 25’ is required and completely within the 75’ <br />foot lakeyard setback. <br />A variance was approved for a new home in 2019 (#LA19-000049). The 2019 approvals have expired. <br />The new application is reflecting similar variances. The home in the 2019 approvals had a 19’ side yard <br />setback, the current application is showing a 21’ side yard setback. <br />3.15.99 Deadline. The application was received on May 18, 2022 and was deemed complete on June 7, <br />2022. The 60-day review period will expire August 6, 2022. <br />4.Planning Commission Vote and Comment. On June 21, 2022, the Planning Commission held a <br />public hearing. The commission discussed the proposed variances and discussed the benefit of moving the <br />proposed house further away from Lake Minnetonka. The commission talked at length about the proposed <br />entrance monuments and provided feedback, noting that the proposed placement of the monuments does <br />not meet practical difficulty standards. However, the commission was open to a redesign of the existing <br />monuments within the existing concrete pad. <br />The commission voted 6-1, on a motion to follow staff’s recommendation to approve the building, <br />hardcover, and retaining walls in the 75’ lakeyard setback, side yard setback, and lot area; and to deny the <br />wetland setback and 75’ foot lakeyard setback request for new entrance monuments. <br />5.Public Comment The applicant submitted two neighbor signatures for the project.
