<br /> <br /> <br />To: Chair McCutcheon and Planning Commission Members <br /> Adam Edwards, City Administrator <br /> <br />From: Jeremy Barnhart, AICP, Community Development <br />Director <br /> <br />Date: May 16, 2022 <br /> <br />Subject: #LA22-000019, City of Orono Text Amendment related to docks in RS zoning <br />districts <br />Public Hearing <br /> <br /> <br />Background <br />In 2020, the City of Orono amended the city code, allowing riparian (lake side) property owners <br />in the RS zoning district to grant easements for non-riparian owners in that zoning district for <br />lake access. Lake access easements are not permitted elsewhere in the city. <br /> <br />This amendment restates that permission within the RS zoning district regulations, to aid the <br />user in finding it. Other changes proposed include removing the provision of the code that <br />granted the City Council authority to issue a permit for a property owner to use public rights of <br />way for inland property access (docks). That provision was in essence replaced with the <br />Council’s licensing program, established in 2021. Any municipal dock must be approved by the <br />LMCD. <br /> <br />Public Comments <br />To date, no public comments have been received. <br /> <br />Issues for Consideration <br />1. Draft Ordinance <br /> <br /> <br />Application Summary: The city of Orono is proposing an ordinance amendment clarifies the <br />ability for lake property owners in the RS zoning district (Big Island, Mahpiyata, and Deering <br />Islands) to provide an easement for inland owners in the RS district, and also remove\s the <br />ability for the city to issue permits for docks on Big Islands. The may still issue licenses for docks <br />in the RS zoning district. <br />Staff Recommendation: Planning Department Staff recommends approval of the draft as <br />written.
