To consider an amendment to the zoning code that lists irrigation systems as permissible <br />encroachments into the required yards. <br /> <br />2. Background. This item was discussed by the Code Review Committee in April. The zoning <br />ordinance lists certain improvements that may be constructed within required yards. Common examples <br />include fences, gates, building eaves, retaining walls, etc. <br /> <br />While irrigation systems are listed as accessory structures, they are not listed as permissible non- <br />encroachments, meaning their required setback is the minimum side, rear, front, and lake yard for that <br />particular zoning district. <br /> <br />Irrigation systems are commonly installed along the property lines, or in the adjacent rights of way, <br />spraying toward the house. <br /> <br />3. Planning Commission Vote and Comment. On May 16th, the Planning Commission held a public <br />hearing. Following the public hearing, the Planning Commission voted 7-0 on a motion to approve the <br />ordinance as drafted. The members of the Commission agreed that irrigation systems in required yards <br />was appropriate. <br /> <br />4. Public Comment. No comments have been received for or against the proposed amendment. <br /> <br />5. Staff Recommendation. Staff recommends the Council adopt the ordinance as drafted. <br /> <br />COUNCIL ACTION REQUESTED <br />Move to adopt the ordinance as drafted. <br /> <br />Exhibits <br />A.
