p CITY OF ORONO <br />RESOLUTION OF THE CITY COUNCIL <br />tie NO. 7235l" <br />IkESHO <br />A RESOLUTION APPROVING <br />A CONDITIONAL USE PERMIT <br />PURSUANT TO <br />MUNICIPAL ZONING CODE <br />SECTIONS 78-348 & 78-916 <br />FILE NO. LA21-000070 <br />WHEREAS, on August 16, 2021, Terrie DeBaker, Metropolitan Council <br />hereinafter the"Applicant"), on behalf of the owner, applied for a conditional use permit <br />hereinafter the"CUP") pursuant to Orono City Code for the properties addressed 3447 Crystal <br />Bay Road legally described as: <br />That part of Lot 3, Block 1, Wiley's Park, Lake Minnetonka, lying Southerly of a line drawn <br />from a point on the Easterly line of said Lot 3, distant 35 feet Northerly of the Southeast <br />corner of said Lot 3, through a point on the Westerly line of said Lot 3 distant 73 feet <br />northerly of the Southwest corner of said Lot 3; and that part of Lot 4, said Block 1, Wiley's <br />Park, Lake Minnetonka, lying Southerly of a line drawn from a point on the Easterly line of <br />said Lot 4 distant 83 feet Northerly of the Southeast corner of said Lot 4, through a point on <br />the Westerly line of said Lot 4 distant 113.5 feet Northerly of the Southwest corner of said <br />Lot 4, Hennepin County, Minnesota. (hereinafter collectively the "Property"); <br />WHEREAS, property is located in the LR-1 C zoning district which permits public <br />service structures as a conditional use. <br />WHEREAS, the Applicant has made application to the City of Orono for a CUP <br />pursuant to Orono Municipal Zoning Code Sections 78-348 and 78-916 to allow the construction <br />of a building for a lift station <br />WHEREAS, on November 15, 2021, after published and mailed notice in <br />accordance with Minnesota Statutes and the City Code, the Planning Commission held a public <br />hearing, at which time all persons desiring to be heard concerning this application were given <br />the opportunity to speak thereon; and <br />WHEREAS, on November 15, 2021, the Planning Commission recommended <br />approval of the CUP; and <br />WHEREAS, on December 6, 2021, the City Council reviewed the application and <br />the recommendations of the Planning Commission and City staff; and
