The easements granted herein are subject to the following restrictions: <br /> (i) The City is prohibited from creating or installing over the existing sanitary <br /> sewer main within the granted Easement Property any stormwater management <br /> ponds or any other type of pond or rain garden. <br /> The above-named Grantors,for themselves,their heirs,successors and assigns do covenant <br /> with the City,its successors and assigns,that they are well seized in fee title of the above-described <br /> Easement Property;that they have the sole right to grant and convey the easement to the City;that <br /> there are no unrecorded interests in the Easement Property; and that they will indemnify and hold <br /> the City harmless for any breach of the foregoing covenants. <br /> Remainder of page intentionally left blank. <br /> Signature page follows. <br /> 222467v1 2 <br />
