PC Exhibit C <br /> LA22-000038 <br /> SONCITY OF ORONO <br /> RESOLUTION OF THE CITY COUNCIL <br /> *,114 <br /> ; NO. 7273 <br /> kESHO <br /> A RESOLUTION <br /> APPROVING AN EMERGENCY SLOPE REPAIR <br /> PURSUANT TO <br /> MUNICIPAL ZONING CODE <br /> SECTION 78-1726 <br /> WHEREAS, on June 9, 2022, Dennis Walsh (hereinafter the "Applicant"), pursuant <br /> to City Code 78-1726, applied for authorization to proceed with an emergency repair to the lake slope <br /> on his property addressed 1354 Rest Point Circle and legally described as: <br /> Lot 11, Subdivision of Lot 14 Rest Point Park, Lake Minnetonka and Lot <br /> 13 Subdivision of Rest Point Park, Lake Minnetonka, Hennepin County, Minnesota <br /> (hereinafter the"Property"); <br /> WHEREAS, the Applicant submitted documentation from a licensed professional • <br /> engineer which indicates the failure of the current lake yard slope on the Property and the existing <br /> retaining walls is imminent; and <br /> WHEREAS, the Applicant has made a request to the City of Orono for an <br /> emergency slope repair pursuant to Orono Municipal Zoning Code Section 78-1726; and <br /> WHEREAS, on June 9, 2022, a corrective restoration plan was provided by the <br /> Applicant's licensed professional engineer to correct and reinforce the existing failing retaining <br /> walls; and <br /> WHEREAS, the engineered plans proposed an expansion of the existing retaining <br /> wall footprint within the 75' setback from the ordinary high water level (hereinafter the "OHWL") <br /> of Lake Minnetonka where no walls are permitted and existing walls are failing; and <br /> WHEREAS, due to their proximity to the OHWL the new, reinforcement retaining <br /> walls will require a setback variance from City Code section 78-1279; and <br /> WHEREAS, on June 27, 2022, the City Council reviewed the request, the <br /> engineered plans, and the recommendations of the City staff; and <br /> NOW, THEREFORE, BE IT RESOLVED that the City Council of Orono, Minnesota <br /> hereby approves the requested emergency slope repair including new engineered retaining walls <br /> as described above based on one or more of the following findings of fact concerning the Property: <br /> 1 <br />
