LA22-000028 <br /> June 21 2022 <br /> Page 2 of 7 <br /> A variance application was approved for a new home in 2019 (LA19-000049). That application <br /> has expired. The new home is asking for similar variances. The 2019 home was approved for a <br /> 19' side yard setback,today's application is proposing a 21'side yard setback. <br /> Practical Difficulties Analysis <br /> Applicants Submittal information:The applicant has identified the unique existing lakeshore and <br /> inlet lake yard as practical difficulties supporting the requested variance. Additionally,they have <br /> provided supporting documentation regarding Practical Difficulties attached as Exhibit B, and <br /> should be asked for additional testimony regarding the application. <br /> Planning Staff Practical Difficulty Analysis: Regarding practical difficulty,Staff finds the inlet is a <br /> practical difficulty supporting variances, and notes the applicant is working to improve the site <br /> by working within the existing building footprint and massing of the proposed home. The new <br /> home is further from the lakeshore compared to the existing home. The applicant is also <br /> reducing the overall hardcover of the property. Due to the location of the existing home in the <br /> lakeyard,grading will need to be done to remove the existing home and restore the lawn and <br /> for the new proposed <br /> Staff finds the wetland buffer setback variance a convenience and not necessary for the use of <br /> the property.
