The property owner proposes to use the property in a reasonable manner not <br /> permitted by the Zoning Chapter. <br /> Response: I plan to use the pole barn as a personal woodshop, which is expressly permitted by the <br /> zoning. <br /> 2. The plight of the landowner is due to circumstances unique to his property not created <br /> by the landowner. <br /> Response: The key issue is the way that 'defined height' is calculated in the case of my home. The <br /> rambler is built into the side of a hill such that it is one story as viewed from the South side, but two <br /> stories as viewed from the North side. However, due to the peculiar way that defined height is <br /> calculated, this does not increase the defined height resulting value from that measured from the <br /> North side, estimated at 16 feet. This results in a very low limit in height for the pole barn. <br /> 3. The variance, if granted, will not alter the essential character of the locality. <br /> Response: This pole barn will not loom over the primary structure. It will appear lower than the <br /> home bya significant margin. It will look no different than anyother pole barn common in the area. <br /> 9 9 <br /> 4. Economic considerations alone do not constitute practical difficulties if reasonable use <br /> for the property exists under the terms of the Zoning Chapter. • <br /> Response: No economic considerations are present. Money is not the issue. <br /> 5. Practical difficulties include, but are not limited to, inadequate access to direct sunlight <br /> for solar energy systems. Variances shall be granted for earth-sheltered construction as <br /> defined in Minnesota Statutes, Section 116106, Subd. 2, when in harmony with this <br /> Chapter. <br /> Response: Trying to build a pole barn as a personal woodshop. Woodshops typically have overhead <br /> apparatus, such as lighting, dust collection duct work, air filters, etc. If I am limited to a 16 foot <br /> defined height on the structure it is very difficult to build a pole barn with a ceiling height enough to <br /> accommodate this. <br /> 6. The Board of Appeals and Adjustments or the Council may not permit as a variance any <br /> use that is not allowed under this Chapter for property in the zone where the affected <br /> person's land is located. <br /> Response: This point is not applicable to this situation, the pole barn is an accessory building less <br /> than 1000 sq feet that will conform to all zoning requirements, and needs a variance only on 'defined <br /> height'. <br /> 7.
