This item is regarding the applicant’s request to refund fees and costs incurred relating to <br />application #LA21-000077. <br /> <br />2. MN§15.99 Application Deadline. The application was received on December 15, 2021 and <br />considered to be complete on January 3, 2022. The 60-Day review period has been extended by the City <br />and now expires on May 12, 2022. <br /> <br />3. Background. In the fall of 2019, the Long Lake Rowing Crew (LLRC) approached the City about the <br />prospect of partnering to construct a boathouse at Orono’s Summit Beach Park. The Park Commission <br />considered the proposal at two meetings November 2019 and March 2020. <br /> <br />In July 2020, the City Council reviewed the LLRC’s request and no formal action was taken by the <br />Council. Following this meeting the LLRC proceeded with plans for the project. In December 2021, the <br />LLRC submitted an application seeking a public-private partnership to construct the Long Lake <br />Community Rowing Center at Summit Beach Park. The application consisted of a request for a zoning <br />text amendment and a conditional use permit to support the proposed use. <br /> <br />Upon receiving a large volume of public comment in opposition, the applicant requested to have their <br />application tabled just prior to the start of the January Planning Commission meeting. Members of the <br />public provided comment during the meeting. <br /> <br />4. Request. The applicant is choosing to withdraw their application at this time. They have requested a <br />refund of application fees as well as reimbursement of some of their incurred costs. Their request is <br />detailed on Exhibit A, attached. Additionally, they would like an opportunity to address the Council <br />during the meeting. <br /> <br />5. Staff Recommendation. Staff does not support a refund of the application fees or for costs incurred <br />by the applicant. <br /> <br />COUNCIL ACTION REQUESTED <br />Council should direct staff regarding the applicant’s request. <br /> <br />Exhibits <br />A.
