The applicant is requesting to reconstruct the retaining walls in the 75’ lake yard with <br />expansion due to the change in building materials. <br /> <br />2. Background. The Council reviewed this application on April 11th and at the March 14th City Council <br />Meetings. The applicant noted the existing block wall are failing and is proposing to replace it with a <br />boulder retaining walls which is considered a footprint encroachment due to the material size. The applicant <br />amended their plans based on the City Council’s direction to follow the same footprint of the existing <br />improvements. Per council’s direction, the applicant has submitted a report from a professional engineer <br />noting the existing wall is failing. (Exhibit B). <br /> <br />3. Engineering Comments: Adam Edwards, City Administer and City Engineer, has reviewed and found <br />the analysis and recommendation are sound and in keeping with standard practices. He noted the findings <br />state the wall should be replaced. The use of the boulder wall construction would be the preferred option <br />as it is less disruptive to the lake yard than an in-kind replacement due to the installation requirements of a <br />block wall. The project that is being proposed make since from an engineering perspective. <br /> <br />4. 15.99 Deadline. The applicant made a complete application on January 18, 2022. The original review <br />period has been extended by staff, the applicant further extended the review period to July 17, 2022. <br /> <br />5. Public Comment One written comment was received in support of the project. The same neighbor, <br />Melissa Santrach at 1700 Bohns Point Rd, attended the meeting and spoke in support of the project. <br /> <br />Staff Recommendation. Planning Staff recommends approval of the variance as revised. The retaining <br />wall follows the path of the existing wall, and the variance is necessary only due to the change in size of <br />the wall materials. Staff believes the replacement of a concrete block wall with a boulder wall more <br />completely meet the goals of the ordinance, which in part, are intended to preserve a natural shoreline. <br /> <br />COUNCIL ACTION REQUESTED <br />Motion to adopt the approval resolution. <br /> <br /> <br />Exhibits <br />A.
