This application is regarding rear and side setback variances in order to construct <br />additions to the existing home. <br /> <br />2. MN§15.99 Application Deadline. The application was received and was considered to be <br />complete on July 21st. The 60-Day review period was extended and expires on November 18, <br />2021. <br /> <br />3. Background/ Summary. The applicant is proposing to rebuild the detached garage, add a <br />second story, and attach it to the home with a 5.9 foot addition on the main level. The existing <br />home has two bedrooms and one bathroom, all on the 2nd floor. The applicant is proposing to <br />reconfigure the main level to accommodate a half bath, and construct an additional <br />bedroom/office and bathroom over the new garage to improve function and livability. <br /> <br />The existing detached garage is 16 feet from the rear lot line, and 1.2 feet from the north side lot <br />line where a 30-foot rear, and 7.5-foot side setback are required. The connecting addition and <br />upper level of the garage will be 1.2 feet from the side lot line and by nature of the connection <br />will become part of the principal building. The connection will therefore result in the house <br />becoming nonconforming by the side and rear setbacks. Setback variances are necessary to <br />facilitate this change to the home. The existing home is currently conforming with respect to all <br />setbacks. The connection of the home and garage will result in the currently conforming home to <br />become nonconforming on the rear and north sides. <br /> <br />4. Planning Commission Vote and Comment. On September 20th, the Planning Commission held <br />a public hearing. Following the public hearing the Planning Commission voted 7 to 0 on a motion <br />to approve the requested variances. <br /> <br />5. Public Comment. No written comments from the neighbors were received. The neighbor <br />acknowledgments are attached as Exhibit D. <br /> <br />6. Staff Recommendation. Staff recommends approval subject to the applicant addressing, with <br />the building permit submittal, the stormwater so that the property to the north is not adversely <br />impacted. <br /> <br />COUNCIL ACTION REQUESTED <br />Motion to adopt or amend the approval resolution. <br /> <br />Exhibits <br />Exhibit A.
