This application is regarding rear and side setback variances in order to construct additions <br />to the existing home. <br /> <br />2. MN§15.99 Application Deadline. The application was received and was considered to be complete <br />on July 21st, 2021. The 60-Day review period has been extended and will now expire on July 16, 2022. <br /> <br />3. Background/ Summary. The Council reviewed this project in October last year and after discussion <br />some Councilmembers expressed their opinion that the proposed expansions and increased <br />encroachments were not supportable. The Council tabled the application at the applicant’s request. <br /> <br />The applicant has provided a revised plan reflecting a <br />proposed 3.5 foot side yard setback, where a 7.5 foot <br />setback is required, in conjunction with rebuilding the <br />detached garage with a 5.9 foot footprint addition to <br />connect it to the home, including a second story. The <br />existing garage is situated 1.2 feet from the lot line <br />and is detached from the home. The revised plans <br />move the entire garage to the south approximately 2.3 <br />feet. They have indicated that they have moved the <br />garage as far south as would be permitted without <br />impacting the existing water supply well. <br /> <br />The goal of the project is to reconfigure the main <br />level to accommodate a half bath, and construct an <br />additional bedroom/office and bathroom over the new <br />garage to improve function and livability. <br /> <br />The revised plan continues to maintain the existing 16 <br />foot setback from the rear lot line where a 30-foot <br />rear, and 7.5-foot side setback are required. <br /> <br />4. Planning Commission Vote and Comment. On <br />September 20th, the Planning Commission held a public hearing. Following the public hearing the <br />Planning Commission voted 7 to 0 on a motion to approve the original variances. <br /> <br />5. Public Comment. No new comments from the neighbors have been received. The neighbor <br />acknowledgments from their original proposal are attached as Exhibit C. <br /> <br />6. Staff Recommendation. Staff recommends approval of the revised plan which offers a greater <br />setback for building maintenance and stormwater distribution.
