7. “The board or council may permit as a variance the temporary use of a one-family
dwelling as a two-family dwelling.”
This condition is not applicable.

8. The special conditions applying to the structure or land in question are peculiar to such
property or immediately adjoining property.”
The configuration of the properties is odd. The narrow portion of Lot 2 that separates
Lot 1 from the lake is awkward, unique and specific to these parcels.

9. The conditions do not apply generally to other land or structures in the district in which
the land is located.”
The proposed parcels are generally consistent with neighboring properties in respect to
size, width and configuration.

10. “The granting of the application is necessary for the preservation and enjoyment of a
substantial property right of the applicant.”
With respect to Lot 1, we believe this to be the case in respect to privacy, views, access
to sunlight and other aspects that any property owner would expect to enjoy.

11. The granting of the proposed variance will not in any way impair health, safety, comfort
or morals, or in any other respect be contrary to the intent of this chapter.”
The variance will not increase the density or intensity of the lots. The granting of the
proposed variance will not in any way impair health, safety, comfort or morals, or in any
other respect be contrary to the intent of this chapter.

12. “The granting of such variance will not merely serve as a convenience to the applicant,
but is necessary to alleviate demonstrable difficulty.”
The overall size of the properties does not allow for the practical difficulties to be
overcome without the approval of the lot width variance. The previously approved odd
configuration of the lots as well as the non-conforming width created the difficulty. The
requested lot width variance is necessary to reconfigure the lot lines and create 3 lake
lots where two lake lots and one non-lake lot currently exist. The request is reasonable
and is consistent with previously approved variance requests.
