The Plaruung Cominission review d this application at a public hearing <br />� held on February 22, 2005. The C ty Council reviewed this application at <br /> the regularly scheduled meetin held on Febniary 28, 2005 and <br />- recommended approval of a front rd setback variance to allow a setback <br /> of 74 feet based on the following fi dings: <br />�.:.: <br />- a. The existing house, which has setback of 77', was constnicted prior <br /> to adoption of the current setba k requirement of 100', <br /> b. Approval of the front yard s tbacic request of 72' would not be <br /> - consistent�vith past approvals l lots with similar conditions. <br /> c. Approval of a front yard set ack variance of 74' by allowing the <br /> garage no fiu-ther forward ,thai the extended front foundation line of <br /> the house will result only i a sl'ght increase in the non-confornlity. <br /> d. The request to increase the nu ber of attached garage stalls from the <br /> existing single stall is a reas nable request based on the current <br /> constnlction trends. <br /> 4. The City Council has considered his application including the findings <br /> and recommendation of the Plaruii g Cointnission, reports by City staff, <br /> comments by the applicants a�1d th public, and the effect of the proposed <br /> variance on the health, safety and elfare of the conununity. <br /> .�: <br /> 5. The City Council finds that the c nditions existing on this property are <br /> peculiar to it and do not apply gei erally to other property in this zoning <br /> district; that granting the varian e would not adversely affect traffic <br /> conditions, light, air nor pose a fir hazard or other danger to neighboring <br /> property; would not merely serve a a convenience to the applicants, but is <br />�; <br /> necessary to alleviate a demonstrab e hardship or difficulty; is necessary to <br /> preserve a substantial property rig t of the applicants, and would be in <br /> keepin� with the spirit and intent o the Zoning Code and Comprehensive <br />__ Plan of the City. <br /> Pa�e 2 of 5 <br />
