<br /> Simply put, Mr. Rivers is requesting rezoning of three parcels of

<br /> r,W - dock. The area to be rezoned is saown on Exhibit 1. The proposed

<br /> BACKGEOUND INF'OR ATION
<br /> ,, In 1979, Windward Marine ' s 1.979 conmei•cial dock license application
<br /> • r` included a proposal far a major rearrangement of the docks on Browns
<br /> .4 Bay. In review of that change, staff took copies` of the proposed site
<br /> •, plan and compared them to platting maps. We then took the 1974 legal
<br /> ,V • desscrinti.ons for the B-2 zone. and marked them on the plat maps and
<br /> #: a• #, the site plan At that point, it 'as apparent that• the proposed
<br /> (,..,...,.,w,•• docks would have extiznded beyond t{.‘: legally described zoning district
<br /> '` ^� k "., boundary. In addit.'�it,n, some of the existing dockage did not conform is
<br /> to LMCD' s required . .dc setbacks.
<br /> Resolution No. 102'! was adopted granting the 1979 license based upon
<br /> i1 ='•t � ' the previous year' s dock arrangement but denying those slips encroaching
<br /> ``:-:` � . beyond the I3-2 lire. This was, subsequently amended to allow in 1979
<br /> ••', '1-4-.; the same number o' slips previously licensed pending review of the `
<br /> ' � zoning issues. See. Exhibit 4 .
<br /> r , There is no question that the City had previously licensed slips on •
<br /> • af I' r Browns Bay per the .1978 incl amended 1979 licenses. The issue is
