L, City of ORONO <br /> r "; 'CITY RESOLUTION OF THE CITY COUNCIL <br /> ( � NO. 2674 <br /> ORONO <br /> A) The total hardcover removed as a result of these <br /> improvements will be 3,534 s.f. or 19%. <br /> B ) The removal of the two existing commercial <br /> structures and the replacement of just one structure at <br /> 4,500 s.f. as originally approved in Application #1263 <br /> will result in a less intense commercial use of this <br /> severely limited property. <br /> C) The amended proposal will provide far more green <br /> area than the original site plan approved with <br /> Application #1263. <br /> D) The applicant has proposed better treatment of <br /> drainage and run-off with the amended proposal. <br /> E) The amended proposal provides the removal of 600 <br /> s.f. of additional hardcover than was required to be <br /> removed with original land use application #1263, <br /> F) The property has sustained a marina use for over 25 <br /> years. <br /> 4. The City Council has considered this application <br /> including the findings and recommendations of the Planning <br /> Commission, reports by City staff, comments by the applicant <br /> and the effect of the proposed variances on the health, <br /> safety and welfare of the community. <br /> 5. The City Council finds that the conditions existing on <br /> this property are peculiar to it and do not apply generally <br /> to other property in this zoning district; that granting the <br /> variances would not adversely affect traffic conditions, <br /> light, air nor pose a fire hazard or other danger to <br /> neighboring property; would not merely serve as a <br /> convenience to the applicant, but is necessary to alleviate <br /> a demonstrable hardship or difficulty; is necessary to <br /> preserve a substantial property right of the applicant; and <br /> would be in keeping with the spirit and intent of the Zoning <br /> Code and Comprehensive Plan of the City. <br /> Page 3 of 7 <br />
