City of ORONO <br /> CITY RESOLUTION OF THE CITY COUNCIL <br /> OF NO. 2442 <br /> ORONO <br /> FINDINGS <br /> 1. This application was reviewed as Zoning File #1263. <br /> 2. The property is located in the B2 Lakeshore Business District. <br /> 3. The Orono Planning Commission reviewed this application on May 16, <br /> 1988 , and recommended approval of the proposed variances based upon <br /> the following findings and hardships: <br /> A) The total hardcover removed as a result of those improvements <br /> will be 8 , 759 s.f. or 23.9%. <br /> B) The removal of the two commercial structures and the <br /> replacement with just one structure will result in a less intense <br /> commercial use of this severely limited property. <br /> C) The area on Brown's Bay side will be designed for outdoor <br /> picnic use by the members of the marina. The storage structure <br /> will be replaced with an extensive green landscaped area with a <br /> gazebo. <br /> D) Access will be better defined with the curbing on both sides <br /> of the street where access would now be provided to designated <br /> parking areas. <br /> E) The applicant has proposed a better control of drainage and <br /> treatment of run-off with this proposal. <br /> F) The new proposal will provide far more green area than the <br /> present facility. <br /> G) The property has sustained a marina use for over 25 years. <br /> 4. The City Council has considered this application including the <br /> findings and recommendations of the Planning Commission, reports by <br /> City staff, comments by the applicant and the effect of the proposed <br /> variance on the health, safety and welfare of the community. <br /> 5. The City Council finds that the conditions existing on this <br /> property are peculiar to it and do not apply generally to other <br /> property in this zoning district ; that granting the variances would <br /> not adversely affect traffic conditions, light, air nor pose a fire <br /> hazard or other danger to neighboring property; would not merely serve <br /> Page 3 of 6 <br />
