WHEREAS, on October 27, 1960, the Grantors and Grantee entered into a <br /> Rezoning Agreement (hereinafter referred to as the Agreement) in Which the <br /> Grantee would agree to amend the Municipal (ode of Orono and grant certain <br /> conditional use permits or variances at the time the Grantors had fulfilled <br /> to the satisfaction of the Grantee all conditions set forth in that <br /> Agreement; and <br /> WHEREAS, The Grantors, as required by that Agreement have applied for a <br /> division for tax purposes of the property lying east of Hennepin County Road <br /> No. 15 from the property owned by Loren Born (P.I.N. 11-11723 22 0003): and <br /> WHEREAS, the Grantee has approved the division granting lot area and <br /> . lot width variances to the existing LR-lA Lakeshore Residential Zoning <br /> District based on the availability of public sanitary sewer and the proposed <br /> use of the property to be consistent with the environmental standards of the <br /> City: and - <br /> WHEREAS, Grantors, as required by that Agreement, have applied for a <br /> conditional use permit and setback variances with their 1981, 1982, and 1983 <br /> commercial dock license applications to permit commercial parking on resi- <br /> dential zoned property aid the placement of pexnanent floating dodo struc- <br /> tures at less than minimum esthetic requirements from abutting residential <br /> properties: and <br /> WHEREAS, the Grantor has applied for a 1981, 1982 and 1983 oonmercial <br /> dock licenses for Windward Marine, Inc., and the Grantee has made a finding <br /> that the proposed level of commercial use is consistent with the objectives <br /> and intent of the B-2 Lakeshore Conrnercial Zoning District as applicable to <br /> Parcels A, B, C & D herein described and Grantee has conditionally approved <br /> a 1981, 1982, 1983 C3oamercial Dock License for Windward Marine, Inc., <br /> subject to the execution of this Agreement. <br /> -3- <br /> 3883 L/R/O <br />
