ORONO COUNCIL, AUGUST 28, 1979 / Page 3 <br /> Mr. Alan Olson, City Planner, entered into the SUBDIVISION <br /> record <br /> record the request of Ken Chapman, 2695 Shadywood 2695 Shadywood Road <br /> Road, for a subdivision, dated August 22, 1979, #428 <br /> which states: Ken Chapman <br /> Mr. Chapman, 2695 Shadywood Road, seeks preliminary <br /> approval of a two-lot subdivision of 1.90 acres <br /> creating substandard lots in a one-acre minimum <br /> zoning district. Each lot will consist of 0.95 <br /> acres requiring a variance of 0.10 sq. ft. or <br /> 5%. The existing access has been approved for a two <br /> lot plat by the Hennepin County Highway Department. <br /> The plat will be served by the existing driveway <br /> that will require an access easement from the east <br /> lot in favor of the west lot. Only the west lot <br /> is to have riparian rights. All new structures <br /> must meet setback requirements because no variances <br /> will be allowed. The existing house on the property <br /> must be removed before a building permit is issued <br /> for lakeside lot. Water and sewer service would <br /> have to be approved for the newly created lot. <br /> Brief History - I have enclosed the Planning Commission <br /> Minutes covering the long "drawn out" review of this <br /> subdivision and their recommendation of August 13, <br /> 1979. The delays involved the applicant's absence , <br /> at preliminary meetings, Planning Commission's request <br /> for applicant to acquire additional land from neighbor <br /> to the south, Council' s decision on the Watson and <br /> Williams area variance applications. At this point, <br /> Mr. Chapman needs a decision by Council before he <br /> proceeds with expensive remodeling and an addition <br /> to the existing home. If he is allowed to plat, <br /> a new home would be located closer to the lake <br /> affording adequate setback from the division line. <br /> Planning Commission approved plat based on the following <br /> findings: <br /> 1. Degree of area variance is minimal - no other <br /> variances required. <br /> 2. Surrounding neighborhood consists of substandard <br /> lots - in consideration of area surveys of lot <br /> for Watson application #462. <br /> 3. Sewer and water available for newly created lot. <br /> 4. No additional curb cuts off County Road 19. <br /> Conditions of approval <br /> 1. Payment of park dedication fee of $440 for newly <br /> created lot. <br /> 2.
