Existing house on lakeshore lot to be removed SUBDIVISION <br /> before building permit is issued for new home. 2695 Shadywood Road <br /> Council should consider a request for temporary (Continued) <br /> occupancy of house until new one is available. <br /> 4 . West lot only, to have riparian rights . <br /> 5. No setback variances to be granted for construction. <br /> Council Meeting - August 28, 1979 <br /> Hurr moved, Butler seconded, to appove the preliminary <br /> subdivision request of Ken Chapman, 2695 Shadywood <br /> Road, per the Planning Commission recommendations of <br /> August 13, 1979 , subject to removing existing house <br /> before building permit is issued. Motion, Ayes (4) - <br /> Nays (0) . <br /> Mrs. Holzer, her attorney Robert Mitchell, and CONDITIONAL USE PERMIT <br /> Mr. Downey were present concerning the conditional 2677 Casco Point Road <br /> use permit application of Alexander Holzer, 2677 Casco #436 <br /> Point Road. Alexander Holzer <br /> Mr. Mitchell reviewed his letter of August 23 , 1979 <br /> explaining his revised plan with pictures and a diagram. <br /> He stated that there would not be any underground <br /> ,pipes and that the installed ones would be removed. <br /> Discussion included the ground elevations and drainage. <br /> Mr. Mitchell stated that the elevation is eight inches <br /> higher than Mr. Smerling' s yard. Mr. Downey stated <br /> that no fill has been brought into the Holzer property <br /> whereas, Mrs. Holzer stated that dirt from the foundation <br /> was spread over the yard when it was installed. <br /> Mayor Van Nest directed Mr. Mitchell to present to the <br /> City Council a topo showing finished elevations and <br /> drainage plan. <br /> Mr. Gilbert, Mr. Smerling' s attorney, stated that <br /> Mr. Mitchell has presented the same plan as previously <br /> presented and does not feel that the Holzer' s have <br /> complied with Council direction. <br /> Massengale moved, Butler seconded, not to accept the <br /> plan as presented in Mr. Mitchell' s letter of <br /> August 23 , 1979. Motion, Ayes (4) - Nays (0) . <br /> Mayor Van Nest moved, Massengale seconded? to direct <br /> Mr. Mitchell to present a plan showing elevations <br /> of Holzer' s house, yard and adjacent yards; that no <br /> blocks be exposed at the front of Holzer house on <br /> the south side and all around to a point where the <br /> present wall intersects the 75 ' line on the Downey <br /> side; that the wall on the Downey side, behind the <br /> 75 ' line, be stepped up to the height of the wall <br /> between the two houses; that the wall he removed <br /> two blocks from the front of Holzer house back to (Continued) <br />
