8. The basis of Orono' s approval of the subdivision of the <br /> Original Parcel was that only the Chapman Parcel shall have <br /> riparian rights and the Letendre Parcel shall have no riparian <br /> rights. <br /> 9 . On March 25, 1983, the easement which is the subject of <br /> this proceeding was granted by Kenneth 0. Chapman and Patricia E. <br /> Chapman to provide lake access rights for the benefit of the <br /> Letendre Parcel. The grant of this easement is invalid in that it <br /> is directly in conflict with all representations made to Orono <br /> that only the Chapman Parcel shall have riparian rights. <br /> 10 . On information and belief, Orono understands that the <br /> purchase price of the Letendre Parcel to Petitioners was reduced <br /> by approximately $40,000 because of the problems involving lake <br /> access to the Letendre Parcel . <br /> 11 . Petitioners had actual or constructive notice that the <br /> Letendre Parcel was to have no lake access across the Chapman <br /> Parcel and Petitioners had actual or constructive notice that the <br /> Letendre Parcel was to have no right to maintain a dock on Lake <br /> Minnetonka. <br /> WHEREFORE, Orono prays that the Petition be denied and that <br /> this Court not issue an Order as set forth in the Order to Show <br /> Cause. <br /> -3- <br />
