The Council suggested the value be based on the Certificate of Real Estate Value (CRV), if one has been filed. The city attorney advises that is must be based on the predeveloped value of the land, and in most cases, the CRV will not have been filed as many sales will be contingent on City approval of the proposed development.

The cost of the appraisal shall be 84 <br />paid by the developer. 85 <br />d. The determination of fair market value of the undeveloped land by the city assessor, city council or 86 <br />designated appraisers shall be determined at the time of final approval. 87 <br /> (9) Future subdivision. Any land which is further subdivided, divided or applied for such subdivision, division 88 <br />subsequent to May 1, 1990, shall be subject to the requirements of the ordinance then in effect concerning 89 <br />dedication of land for public purposes; and credit shall be given for any charges previously imposed upon 90 <br />that land if the developer can prove that fees were previously paid. In no event shall the city be liable for any 91 <br />payment which may be due because of a subsequent reduction in the application percentage of land or 92 <br />equivalent market value in cash to be dedicated. 93 <br />(10) Request for deviation. The dedication requirements based on the development's proportional share of the 94 <br />City park system are presumptively appropriate. A developer may request a deviation from the presumptive 95 <br />requirements based upon the anticipated impact of that particular subdivision. The request must be made to 96 <br />the Council as part of an application for Final plat approval. 97 <br />SECTION 2.
