To consider an ordinance amendment related to Park dedication when property is <br />subdivided or developed. Also consider a summary ordinance for publication purposes. <br /> <br />2. Background/ Council Vote. When the City Council reviewed the subdivision code in 2018, it was <br />noted that a review of the park dedication requirements was warranted, given the dedication requirements <br />were last reviewed in 2011 and amended in 2001. The City Council discussed the park dedication process <br />at workshops in November and December, 2021. <br /> <br />The draft park dedication requirements are based on a desire that new development pays for its self, <br />without overly burdening existing taxpayers. In essence, the ratio of existing park land and trails to <br />existing households is maintained for each new household added to the city. For every household in <br />Orono, there is .09 acres of parkland and 5 feet of trails. To maintain this ratio, park dedication is <br />proposed at 0.1 acres of parkland per new residential unit. A similar ratio is developed for commercial <br />and industrial developments, based on employees or acres. Where a land donation is not appropriate or <br />desired by the City, the cash equivalent of the land is found based on the subject parcels predeveloped <br />value. These funds may be used to acquire new parks or improve existing parks. It may not be used for <br />park maintenance, or for other general fund purposes. <br /> <br />In December, the Council discussed how the predeveloped value of the land was determined, and directed <br />staff to include the value noted on the Certificate of Real Estate Value (CRV). The City Attorney <br />recommends against that practice because that value isn’t the predeveloped value. The draft ordinance <br />uses the advice of the County Assessor, an appraisal paid for by the applicant, or an agreed upon value <br />between the City and the developer as the options for determining value. The third party valuation <br />recommended by the County Assessor is used most frequently. <br /> <br />3. Planning Commission Vote and Comment. On January 18th, the Planning Commission held a <br />public hearing. Following the public hearing, the Planning Commission voted 4 – 0 on a motion to <br />approve the proposed ordinance. The draft minutes from that meeting are attached as Exhibit D. <br /> <br />4. Public Comment. No written comments have been received in support or opposition to the draft. <br />During the Public Hearing, one resident did not support the use of the park dedication for improvements <br />to the parks, and also felt that adequate notice of the proposed change was not given. <br /> <br />5. Staff Recommendation.
