Gaffron' .4 _ <br /> Title: Senior Planning Coordinator <br /> Item Description: Hanning Right-of-Way Credit- Resolution <br /> List of Attachments <br /> A - Resolution (6- <br /> %B - Staff Memo of 10-21-99 <br /> On October 28 Council directed staff to draft appropriate documents by which the City would enter <br /> into a binding agreement with the Hannings in regards to future use of the right-of-way taken from <br /> their property for the County Road 6 upgrade. Specifically,such an agreement would allow the use <br /> of said right-of-way as area credit toward the 5-acre area requirement should the Hannings wish to <br /> subdivide in the future. <br /> The City Attorney has suggested that a `resolution of intent to enter into an agreement' is a logical <br /> first step toward resolving the litigation between Hennepin County and the Hannings regarding the <br /> value of the land taken for right-of-way. The City is an indirect party to this litigation since the City <br /> is responsible for half of the right-of-way acquisition costs,and therefore has a stake in the outcome. <br /> COUNCIL ACTION REQUESTED <br /> Review and adopt or amend/adopt the attached resolution. <br />
